The list of "disparate impacts this will have on protected classes" that I initially gave them was like six times as long as what made it into the final version, and that was definitely one of them, yeah. I think they didn't feel the "conflicts with the ADA" argument was strong enough to use page count on because there's no specific mention in the law of individual age-verification systems to use yet -- that part is going to be delegated to the implementation agency, and the facial recognition/video verification is more speculative at this point because it's just certain groups advocating that the implementation agency recommend their technology and it's not certain yet that the agency will -- but I hope that if this effort to overturn the law fails, a disability advocacy group sues the implementation agency over the incompatibility with the ADA once we get to that point.
